If the accused or the defendant absconds or is likely to abscond, what should the bailor do?

The person enforced by the bail conditions may seek assistance from the nearest administrative officer or police to arrest the accused or the defendant. In the case where there is no such assistance, such person shall have the power to arrest the accused or the defendant. After arresting, such person shall send the accused or the defendant to the nearest administrative officer or police.

What is the consequence if the bailor fails to bring the accused or the defendant to appear before the court?

The failure to bring the accused or the defendant to appear before the court without reasonable grounds is a breach of bail conditions.

The court, then, shall order the bailor, enforced by the bail conditions, for fine payment and seize the securities to the auction if the fine is not paid.

Remark
If bailor, enforced by the bail conditions, can bring the accused or the defendant to appear before the court without delay, the court shall adjust the fine payment at the amount as it deems appropriate.

How can bailor appeal the fine payment order?

In case where there is any breach of bail condition and the court of the first instance has an order to enforce the bail conditions, the person who is enforced or the public prosecutor can appeal such court order to the Court of Appeal or a regional court of appeal within one month from the date on which he/she acknowledges such court order. This appeal is free of charge and there is no restriction on appeal. The judgment of the Court of Appeal or a regional court of appeal is final and unable to be appealed to the Supreme Court.

How to revoke the bail in the court?

The bailor may revoke the bail or retrieve the bail security at any time by bringing the accused or the defendant to the court. The liability under bail is ceased when the application to revoke the bail or retrieve the bail security has been granted.

    Thank you for straightforward answers to question about Thailand Legal Support. Many foreigners have no regard for Thai Law structure so make many bad decision and act in bad way without respect for Thailand People. Also there are instances Thai person have hatred for Farang. I am Canadian and have more Thailand Friends than Farang friends. So I only respect anyone that have Respect for all People. The Thai Law is full of good example how to be good person, that is the Law I follow. The Respect of Thailand King Bhumipol is very important for me because most Farang have no heart for the Thai Law and not show due Respect to the King of Thailand.
